When you are forming a 501(c)(3) public charity or any other type of tax-exempt organization, you must first form a nonprofit corporation.
Your organization must accomplish a number of things to obtain nonprofit status, including adopting bylaws, obtaining an employer identification number, and preparing and submitting an application to the IRS to request approval of your organization as exempt under Internal Revenue Code Section 501(c)(3).
In general, if you have done things properly, you can obtain your nonprofit status within six months. Without proper guidance, however, the process can be confusing and frustrating.
